Distance Sales Contract

1. PARTIES TO THE CONTRACT

1.1. THE SELLER (SERVICE PROVIDER)

1.2. THE BUYER (CUSTOMER)

The individual who visits, uses, and/or makes a booking/purchase via colmenyatravel.com. The contact, identity, and billing information provided by the Buyer during the checkout process shall be taken as the basis for this Contract.

2. SUBJECT OF THE CONTRACT

The subject of this Contract is the determination of the rights and obligations of the parties in accordance with the consumer protection legislation regarding the sale and digital delivery of the travel services (tours, excursions, transfers, and daily trips) ordered by the Buyer electronically through the Seller’s website.

3. CHARACTERISTICS AND PRICING OF THE SERVICE

  • The type, duration, date, pickup location, and price of the travel service are as stated on the relevant tour/service page and specified in the checkout summary at the time of booking.
  • All prices listed on the website include applicable taxes unless stated otherwise.
  • The total amount will be collected from the Buyer’s chosen payment method upon completion of the transaction.

4. DELIVERY TERMS (DIGITAL PROVISION)

  • Since the subject of this contract is a service (travel/tourism), no physical shipping or delivery is applicable.
  • Upon successful payment, the reservation confirmation and digital ticket/voucher will be delivered instantly to the Buyer via the e-mail address and/or WhatsApp number provided during the purchase.
  • The Buyer is responsible for checking their digital delivery and notifying the Seller immediately if any errors or delays occur.

5. CANCELLATION, REFUND, AND CHANGE TERMS

The Buyer accepts that any refund or modification request will be processed under the following rules based on the time remaining until the scheduled service:

  • 48 Hours or More Notice: 100% full refund will be issued.
  • Between 24 and 48 Hours Notice: 50% refund will be issued.
  • Less Than 24 Hours Notice / No-Show: Strictly non-refundable.
  • Force Majeure: If the tour is cancelled by Colmenya Travel due to severe weather, natural disasters, or safety restrictions, a 100% full refund or alternative date will be provided.

6. RIGHT OF WITHDRAWAL (EXCEPTION FOR TRAVEL SERVICES)

Pursuant to international consumer laws and Article 15 of the Turkish Regulation on Distance Contracts, the right of withdrawal within 14 days without giving any justification does not apply to contracts relating to accommodation, transport of goods, car rental services, catering or services related to leisure activities if the contract provides for a specific date or period of performance. Therefore, the cancellation and return rules stated in Section 5 shall apply.

7. DISPUTE RESOLUTION AND JURISDICTION

In the implementation and interpretation of this Contract, the Consumer Arbitration Committees and the Consumer Courts in Antalya, Turkey shall have jurisdiction up to the value declared by the Ministry of Trade.

8. EFFECTIVENESS

By completing the payment and checking the “I accept the Distance Sales Contract” box on the checkout page, the Buyer is deemed to have read, understood, and accepted all the terms of this Contract.
